Abstract

The aim of this article is to analyze the challenges of recognizing the right to be forgotten in Mexico from the perspective of Hans-Georg Gadamer’s hermeneutic ontology, taking as a reference point the configuration of this right in the European context and its absence in Mexican legislation. It examines the need for a philosophical interpretation of this legal phenomenon that recognizes historicity, language, and tradition as constitutive elements for understanding law in the digital age, going beyond mere technical regulatory reform. From this perspective, it is argued that the right to be forgotten should be interpreted as a fundamental right aimed at protecting the dignity and autonomy of the individual.
